1.Acceptance of these terms

These terms govern your use of the Whitestar Cruise & Travel website (portal.wscruise.co.za) and its online services, including the client account portal and the chat assistant. By accessing or using our website, you acknowledge that you have read, understood and agree to be bound by these terms.

If you do not agree with any part of these terms, you must not use our website.

Booking a cruise is covered separately by our booking terms and by the terms of the cruise line concerned. How we handle personal information is explained in our privacy policy.

2.Use of the website

You may use our website for personal, non-commercial purposes only. You agree not to:

• disrupt or interfere with the functioning of the website or its security features;
• try to gain unauthorised access to any part of the website, other users' accounts or our systems;
• use automated tools (such as scrapers or bots) to copy content or prices, or to submit forms;
• submit false, misleading or someone else's information, or make bookings you don't intend to take;
• use the website for any unlawful purpose.

Unauthorised use of any content or materials on our website may violate copyright laws, trademark laws and other intellectual property rights.

3.Your account

If you create a client account, you are responsible for keeping your sign-in details secure and for activity on your account. Tell us straight away at info@whitestar.co.za if you think someone else has accessed it. Please keep your details, including passport information, accurate and up to date.

4.Prices, availability and information on the website

We work hard to keep the website accurate, but cruise information changes often. Itineraries, ships, cabin categories, inclusions, images and promotions are supplied by or based on information from the cruise lines, and may change.

Prices shown in South African rand (ZAR) or any other display currency are indicative. Many are converted from the currency the cruise line prices in and depend on availability, fare type and exchange rates. A price is only confirmed when a Whitestar specialist confirms it in a quote or booking confirmation. Sending a booking request through the website does not create a booking.

5.Chat assistant

The chat assistant on our website uses artificial intelligence to answer general questions. Its answers may be incomplete or wrong, and they are not quotes, offers or advice. Please confirm anything important, such as prices, availability, entry requirements or health matters, with a Whitestar specialist or the relevant authority. Don't share passport, payment or health details in the chat.

6.Intellectual property

All content on our website, including text, graphics, logos and images, is the property of Whitestar Cruise & Travel or its partners (including the cruise lines we represent) and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, modify or create derivative works from any content without our prior written consent.

7.Third-party links

Our website contains links to third-party websites and resources, such as cruise lines and social networks.

Whitestar Cruise & Travel is not responsible for the availability, content or accuracy of any third-party website linked to our website. The inclusion of a link does not imply endorsement of, or association with, the linked website.

8.Disclaimer of warranties

Our website is provided on an "as is" and "as available" basis. To the extent the law allows, we make no warranties or representations, express or implied, about the website, including that it will be uninterrupted or error-free.

We do not guarantee the accuracy, completeness or reliability of the information and materials on our website (see section 4). Nothing in these terms limits any rights you have under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002 that cannot lawfully be excluded.

9.Limitation of liability

To the extent the law allows, Whitestar Cruise & Travel is not liable for any direct, indirect, incidental, consequential or special damages arising from your use of our website, your inability to access or use it, or any errors, omissions or inaccuracies in its content. This does not exclude liability for our gross negligence or wilful misconduct, or any liability that cannot be excluded by law.

10.Indemnity

You agree to indemnify and hold Whitestar Cruise & Travel and its affiliates, directors, officers, employees and agents harmless from any claims, damages, liabilities, costs or expenses arising out of your misuse of our website or your breach of these terms.

11.Governing law and jurisdiction

These terms are governed by and interpreted in accordance with the laws of the Republic of South Africa. Any dispute arising out of these terms is subject to the jurisdiction of the South African courts.

12.Changes to these terms

We may change these terms at any time. The updated terms will be posted on this page with a new "last updated" date, and your continued use of the website after that means you accept them.

13.Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions remain in full force.
